Prerequisites: upper-division standing or consent of instructor
Description: Examines the intellectual and political sources of the Constitution in English, colonial, and revolutionary war history; the Philadelphia convention and the debate over ratification; the formative impact of the Marshall court; and the crisis over slavery and the nature of the Union. Discusses the role of the court in protecting U.S. capitalism and then examines the court’s role in legitimizing the New Deal by 1953. The main materials of the course are the actual opinions of the court.
